1.1 The competition is a skill-based competition operated by Whyn Ltd. (“the Organiser”). Our contact details are available on our website.
1.2 Entrants must be over 18 years of age. Employees of WHyn Ltd., any group companies, and anyone professionally connected with the competition are not eligible to enter.
1.3 You are responsible for ensuring that the contact details you provide are accurate and kept up to date.
1.4 You are not deemed to have entered the competition until you have both paid and received confirmation from us that your entry has been accepted. We accept no responsibility for entries which are incomplete, delayed, damaged, corrupted, misdirected, or not received for any reason.
1.5 For each order, you may only select one answer to the skill-based question. That same answer will apply to all tickets purchased within that order.
1.6 It is a condition of entry that you comply with these Terms & Conditions and with any other competition requirements specified on the relevant competition page on our website. We reserve the right to reject or cancel any entry that, in our reasonable opinion, does not comply.
1.7 Your entry will be automatically cancelled if any payment by you is charged back, reversed, or deemed invalid for any reason.
1.8 The competition will close on the date shown on our website. We reserve the right that, if all tickets have not been sold by the stated closing date, ticket sales may be extended for a further 15 business days beyond the original end date.
2.1 Within 24 hours of the closing date, we will draw the winner(s) at random from those who have submitted correct answers.
2.2 Winners will be notified by email to the email addresses supplied to us, and prizes will be sent to the postal address provided. If we are unable to contact any winner via the email address supplied, or if delivery of any prize fails despite reasonable attempts by us, the prize will lapse, and we reserve the right to offer the prize to a substitute winner.
2.3 The winner’s prize(s) will be as specified on our website. We reserve the right to substitute the prize for one of equivalent value where circumstances make it necessary.
2.4 We do not guarantee that prizes will be received within any period following dispatch. It is your responsibility to contact us if you do not receive your prize within a reasonable time after our notification email.
2.5 If the winner is located outside the United Kingdom, a contribution of £250 will be provided towards travel costs. Any further travel, accommodation, duties, or taxes applicable remain the sole responsibility of the winner.
2.6 Prizes are provided “as is” and come without any guarantees or warranties as to quality, condition, or suitability for a particular purpose.
3.1 Upon being selected as a Winner, WHyn Ltd. will contact the Winner to request a copy of valid photo identification to confirm their identity, age, and (where applicable) to verify that the debit or credit card used to purchase the Entry was legally theirs. If the card used to purchase an Entry was not legally theirs, the Entrant must provide proof that they were authorised to use it before any prize will be paid or delivered.
3.2 The Winner must provide the required proof of identification and card ownership within five (5) days of being contacted by WHyn Ltd. Failure to do so may result in disqualification and WHyn Ltd. selecting an alternative Winner.
3.3 The Winner will be notified of the prize (or prize options, if applicable) associated with the Competition they entered. In addition to confirming their acceptance of the prize, they must also provide written confirmation of their choice of prize (if relevant), within five (5) days of being contacted.
3.4 Following receipt and verification of the details requested, the Winner will be contacted to arrange delivery of the prize. The Winner must agree to delivery arrangements with WHyn Ltd. within seven (7) days. If the Winner fails to comply with any of the stipulated deadlines, WHyn Ltd. reserves the right, at its sole discretion, to invalidate the winning Entry and to select an alternative Winner. The original Winner will then forfeit any claim to the prize.
3.5 If an Entrant is subsequently found to have abused discount codes or entered competitions using multiple email addresses, their ticket(s) and/or prize will be void. The prize will then be awarded to the next name drawn.
3.6 All Winners agree to provide photographs and/or videos and/or to pose for photographs and/or videos at the request of WHyn Ltd.. Such material, together with the Winner’s name and/or social media handle (“the Content”), may be used in future marketing and public relations by WHyn Ltd. across any media channels, including but not limited to Facebook, Instagram, YouTube, and the WHyn Ltd. website. Winners consent to the use of the Content in this way but may withdraw consent in writing at any time prior to publication. All photographs and videos produced will be deemed the property of WHyn Ltd. WHyn Ltd. accepts no responsibility for any liability incurred by the Winner because of publication of the Content.
3.7 Any Winners located outside the UK are responsible for any applicable taxes and duties.
3.8 Entrants from the following countries are not permitted to enter our competitions. If any ticket purchases are made from these jurisdictions, they will be refunded immediately: Cuba, Iran, Venezuela, the Crimean region of Ukraine, Donetsk and Luhansk, North Korea, Myanmar, Belarus, and Mali.
4.1 Nothing in this agreement in any way limits or excludes our liability for negligence causing death or personal injury, for fraud or fraudulent misrepresentation, or for anything which may not legally be excluded or limited. In this section, any reference to “we” or “us” includes our employees and agents.
4.2 We shall not be liable for any loss or damage caused by us or our employees or agents in circumstances where:
4.3 You will be liable for any reasonably foreseeable loss or damage we suffer arising from your breach of this agreement or misuse of our service (subject of course to our obligation to mitigate any losses).
5.1 We shall not be liable for any failure or delay in performing our obligations under this agreement where such failure or delay results from any event beyond our reasonable control (“Force Majeure Event”).

6.2. If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms and conditions affects your rights as a consumer to rely on such mandatory provisions of local law. You may be entitled to use an EU online dispute resolution service to assist with any contractual dispute you may have with us. This service can be found here.
7.1 In all matters arising in connection with the competition, the decision of WHyn Ltd. shall be final.
7.2 Winners will always be selected using [●]. Certificates of each draw can be provided on request.
7.3 No correspondence will be entered into regarding the outcome of any competition.
7.4 We reserve the right to cancel the competition at any time and for any reason. If so, we will refund any payments made.
7.5 Consumer “cooling-off” rights do not apply to this contract as it relates to leisure activities with a specific date for performance.
7.6 We may send all notices under this agreement by email to the most recent email address you have supplied to us (unless otherwise stated in this agreement).
7.7 Headings used in this agreement are for convenience only and shall not affect its interpretation.
7.8 Any failure by either party to exercise or enforce any right or provision of this agreement shall not constitute a waiver of such right or provision.
7.9 If any provision of this agreement is found to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall continue in full force and effect.
7.10 A person who is not a party to this agreement shall have no rights to enforce any of its terms, except insofar as expressly stated otherwise.
7.11 The parties are independent contractors. Except as expressly stated in this agreement, nothing shall be construed as creating a partnership, joint venture, agency, or employment relationship between the parties.

12.5 Whyn Ltd may transfer this agreement to a third party but this will not affect your rights or obligations.
12.6 A person who is not a party to this agreement shall have no rights to enforce this agreement except insofar as expressly stated otherwise.
Note: consider adding a clause limiting liability – for example, specifying that Whyn Ltd’s liability is capped at the amount paid for the entry ticket, and not at the value of the prize won.: eg. 9.X In relation to competitions or prize draws, the total liability of Whyn Ltd to any entrant shall in no circumstances exceed the amount paid by the entrant for the relevant ticket or entry fee. Whyn Ltd shall not be liable for the value of any prize or object that may be won.
